Terms of use

Last updated

These terms apply to your use of this website and its free website visibility check (SearchNivo), provided by Deplova Ltd (“Deplova”, “we”, “us”). By running a check, reading a result, leaving your details or otherwise using this site, you agree to them. If you do not agree, please do not use the site.

If you use the site on behalf of a business, you confirm that you are allowed to accept these terms for it, and “you” means that business as well as you. Please read sections 3, 4 and 11 in particular: they explain that the check is not a guarantee of anything, and limit our liability.

1. Who we are

Deplova Ltd is a UK web and search agency, registered in England and Wales (company number 16633010). SearchNivo is the name of our free check. The site is intended for businesses and organisations, mainly in the UK. You can reach us through our contact form.

2. What the check is

The check is an automated tool. It reads up to 25 publicly available pages of the website address you give us, without running their JavaScript and obeying the site’s robots.txt, and compares what it finds against a set of checks for search engine optimisation (SEO), answer engine optimisation (AEO) and generative engine optimisation (GEO, visibility in AI assistants). It then reports scores and findings.

Those checks, and the way we weight them into scores, are our own. We put them together from our research into guidance that search engines and AI providers publish, industry studies and our own experience. They reflect what we believe helps a website be found, understood and recommended. They are our opinion, not a standard.

Search engines and AI providers do not publish exactly how they rank websites or choose what to show and recommend, and they change their systems often and without notice. Nobody outside those companies can know for certain what will work. Our scores are not produced, endorsed or used by any search engine or AI provider.

The results are general information about a website. They are not professional advice of any kind, including legal, accessibility, security, data protection or financial advice, and they are not a full audit.

3. No guarantees

The check is free and is provided “as is” and “as available”. We do not promise or guarantee:

  • any search ranking, position, traffic, enquiries, sales, revenue or other business result;
  • that your business will appear in, be cited by or be recommended by any search engine, AI assistant or answer feature, such as Google, Google’s AI Overviews, ChatGPT or Perplexity;
  • that acting on the findings will improve your visibility, or that it will not reduce it;
  • that the results are accurate, complete or up to date, or that the check finds every problem. It reads only a sample of pages, cannot see pages that are blocked, private or built by JavaScript, and can be wrong;
  • that two checks of the same site will give the same scores, or that our scores match anybody else’s;
  • that the site or the check will always be available, uninterrupted, secure or free of errors.

To the fullest extent the law allows, we exclude all conditions, warranties and other terms that might otherwise be implied into these terms by statute, common law or otherwise, including about quality, accuracy and fitness for a particular purpose.

4. Acting on the results

Whether and how you act on the results is your decision, and at your own risk. Changes to a website can have effects nobody intended, including losing rankings, traffic or functionality. Before you change your website, keep a backup, check the change with whoever built or manages your site, and take qualified professional advice where it matters to your business.

If you would like help, contact Deplova through our contact form or our website. Any advice or work we give you beyond the automated check is provided only under a separate written agreement (see section 7). We are not responsible for changes that you, or anyone other than us under such an agreement, make to a website.

5. What you may check, and how

You may check a website you own, manage or have permission to assess, or any website that is publicly available. You are responsible for the address you submit. You must not:

  • use the check to attack, overload, probe or test the security of any website or system, or to get round its access controls;
  • run checks by script, bot or other automated means, or try to get round our rate limits, bot protection or other safeguards;
  • copy, scrape, resell or reverse engineer the check, its methods or its results to build or offer a competing product or service;
  • give us details that are false or belong to somebody else without their permission;
  • use the site in breach of any law or regulation, or of anybody else’s rights.

We limit how many checks one person, network or website can have, and we may refuse, stop or withdraw a check, or block your access, at any time and without giving a reason.

6. Results

A result page can be opened by anyone who has its link. Keep the link private if you do not want others to see it. Results are deleted 30 days after the check; we keep only a short record that the website was checked, when, and its scores (see our privacy policy). Each website gets one free check every 30 days: if the same website is checked again sooner, by you or anybody else, we show the most recent result rather than run a new check.

You may use and share your results for your own business purposes. You must not present them as your own work or product, change them and present them as ours, or suggest that we endorse you or your website.

7. Our services and the free fix plan

The packages and prices described on this site are an invitation to get in touch, not an offer we are bound to accept. Prices are “from” prices, shown excluding VAT with the VAT-inclusive total alongside, and may change before anything is agreed. What a package includes for your site, and its price, is confirmed only in a written proposal.

If you ask for a fix plan, it is free and there is no obligation on either side. A fix plan, proposal or reply from us is our opinion of what we would do, given what we can see. It is not a guarantee, and it is not a contract. Any work we do for you is agreed separately in writing, with its own terms, scope and price, and those terms apply to that work instead of these. Nothing on this site creates a contract for services.

8. Our intellectual property

The site, the check, its checks, scoring methods, text, design and the content of the results belong to us or our licensors. Apart from the use of your results allowed in section 6, and viewing the site in the normal way, you may not copy or reuse any of it without our written permission.

9. Other companies and websites

Google, ChatGPT, Perplexity and the other products and companies named on this site are trade marks of their owners. We are not connected with, endorsed by or sponsored by any of them; we name them only to describe what the check looks at. Links to other websites are for your information; we are not responsible for their content.

10. Changes to the check

We may change, suspend or withdraw the check or any part of the site at any time, including what it checks, how it scores and how many pages it reads. Because checks and scoring change, a later check of the same site may score it differently even if nothing on the site has changed.

11. Our liability

What we do not limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude. If you are a consumer, nothing in these terms affects your legal rights.

If you use the site for a business. The site is intended for business use. To the fullest extent the law allows, we are not liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss of profit, sales, revenue or business; loss of rankings, traffic or visibility; loss of business opportunity, goodwill or reputation; loss or corruption of data; wasted time or expenditure; or any indirect or consequential loss, in each case arising from or in connection with the site, the check or its results. Our total liability to you arising from or in connection with them is limited to £100.

If you are a consumer. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any business losses: the check is provided for business purposes, so if you use it for one we have no liability to you for loss of profit, business, rankings, traffic, business interruption or business opportunity.

In particular, and in either case, we are not responsible for decisions you take, or do not take, because of the results, or for the effect of any change made to a website because of them.

12. Your responsibility to us

If you use the site in breach of section 5, for example by checking a website you had no right to have checked in a way that harms it, you are responsible for the losses, costs and claims we suffer as a result, including reasonable legal costs, to the extent the law allows.

13. Events outside our control

We are not responsible for any failure or delay caused by events outside our reasonable control, including the failure of a hosting, network or email provider, or a change made by a search engine or AI provider.

14. Privacy

How we handle personal data is described in our privacy policy.

15. Questions and complaints

If you have a question or a complaint about the site or the check, please contact us and we will reply as soon as we reasonably can.

16. General

  • These terms and our privacy policy are the whole agreement between you and us about the free check and this site. A separate written agreement covers any services we provide.
  • We may update these terms from time to time; the date at the top says when we last did. The version in force when you use the site applies.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • We may transfer our rights and obligations under these terms to another organisation. Nobody other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
  • These terms, and any dispute or claim arising from or in connection with them or the site (including non-contractual disputes or claims), are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
